The Services are for the personal use of individual members to advertise and promote their profiles for the purpose of finding a relevant and suitable match and cannot be used in connection with any commercial endeavors.

The Services is a serious matchmaking platform to seek a life partner.

Registration on the Shudh Matrimonial And Dating Services (opc) Pvt. Ltd. website (www.shudhmatrimonial.com) / app ("Site") is free. However, Shudh Matrimonial also offers premium memberships wherein you ("Member", "User" or "you") can promote your profile.

1. Acceptance of Terms of Use.

These are the standard terms of use ("Terms of use") between Shudh Matrimonial And Dating Services (opc) Pvt. Ltd. having their office at 1550/110, 1st Floor, Ganesh Pura, Tri Nagar, Delhi 110035 (hereinafter referred to as "Shudh Matrimonial And Dating Services (opc) Pvt. Ltd.", or "us," or "we") and you.

By using the Site, you agree to be bound by these terms of use ("Agreement"). If you wish to become a Member and promote/ advertise your profile to other Members and make use of the services offered by Shudh Matrimonial And Dating Services (opc) Pvt. Ltd. on their Site ("Service"), you are requested to read the terms of the Agreement and follow the instructions to complete the registration process. By using the Service, you consent to submit your personal identifiable information, to collect, process, display and use the such information to avail the Service.

This Agreement sets out the legally binding terms of use for the Site and membership associated with it. This Agreement may be modified by Shudh Matrimonial And Dating Services (opc) Pvt. Ltd. from time to time. Shudh Matrimonial And Dating Services (opc) Pvt. Ltd. reserves all the rights to alter the terms of this Agreement as it may deem fit in its sole and absolute discretion without any obligation of issuing any prior notification.

The membership and rights of admissions are reserved.

In order to use the Service you must register as a member on the Website/ Community sites/ mobile applications ("Site"). This Agreement is an electronic contract and does not require digital or electronic signatures. The Agreement establishes the legally binding terms you must accept to use the Site and to become a "Member." For purposes of this Agreement, the term "Member" means a person who voluntarily submits information to the Site and uses/avails the Service on the payment of the Subscription Fee.

To withdraw this consent, you must discontinue using our Service and delete your account on the Site.

2. Eligibility

By using this Site, you represent and warrant that you have the right, consent, authority, and legal capacity to enter into this Agreement; submit relevant information to Shudh Matrimonial And Dating Services (opc) Pvt. Ltd.; and that you are not prohibited or prevented by any applicable law for the time being in force or any order or decree or injunction from any court, tribunal or any such competent authority restraining you from entering into matrimony.
• 4. You further confirm that you, intent to seek a life partner and that you shall not use this Site for casual dating. You also agree to abide by all the terms of this Agreement. If at any time Shudh Matrimonial And Dating Services (opc) Pvt. Ltd. is of the opinion (in its sole discretion) or has any reason to believe that you are not eligible to become a Member or that you have made any misrepresentation, Shudh Matrimonial And Dating Services (opc) Pvt. Ltd. reserves the right to forthwith terminate your membership and / or your right to use the Service without any of your unutilized Subscription Fee.
• 5. You consent and agree not to dispute the use of the information shared by you, including but not limited to your pictures, contact number, etc. for the creation of your profile on the Site during the time your profile remains active on the Site.

3. Subscription Fee

There is no fee which is charged by Shudh Matrimonial And Dating Services (opc) Pvt. Ltd. to the Users for registering and creating an account on the Site.

However to avail the Services offered on the Site, the User will be liable to pay a pre-decided quantum of money ("Subscription Fee") to Shudh Matrimonial

The payment of Subscription Fee on monthly, quarterly or annual basis is on the discretion of the User. The eligible mode(s) of payment of the Subscription Fee has been mentioned on the Site.

4. Account Security.

You are solely responsible for maintaining the confidentiality of your login credentials you designate during the registration process, and you are solely responsible for all activities that occur under your account. You agree to immediately notify us of any disclosure or unauthorized use of your account or any other breach of security, and ensure that you log out from your account at the end of each session. You shall be responsible for all the activities that occur on the Site through your login credentials.

5. Term and Termination.

• 0. This Agreement will be effective, valid and subsisting as long as you use our Site as per the terms of the Agreement and on payment of Subscription Fees for availing the Services offered on the Site.
• 1. You may terminate your membership at any time, for any reason by writing to Shudh Matrimonial And Dating Services (opc) Pvt. Ltd. In the event you terminate your membership, you will not be entitled to a partial/full refund of any unutilized Subscription Fees, if any, paid by you, except where otherwise guaranteed in writing.
• 2. Shudh Matrimonial And Dating Services (opc) Pvt. Ltd. LTD may terminate your access to the Site and/or your membership for any reason including but not limited to breach of the terms of use, using the service for commercial purpose, engaging in prohibited or inappropriate communication or activity, by sending notice to you at the email address as provided by you while registering on the Site or such other email address as you may later provide to Shudh Matrimonial And Dating Services (opc) Pvt. Ltd. If Shudh Matrimonial And Dating Services (opc) Pvt. Ltd. terminates your membership for breach of terms of this Agreement, you will not be entitled to any partial/full refund of any Subscription Fees, if any, paid by you.
• 3. Certain provisions of this Agreement including sections 4, 5, 6, 7 and sections 9 to 16, of this Agreement shall remain effective even or termination.
• 4. Term for the paid Membership would be depend on period for which Subscription Fee has been paid to Shudh Matrimonial And Dating Services (opc) Pvt. Ltd. by the Member namely monthly, quarterly or annually.

6. Non-Commercial Use by Members.

The Site is for the personal use of individual members to advertise and promote their profiles for the purpose of generating invitations from relevant matches and cannot be used in connection with any commercial endeavors. This includes providing links to other web sites, whether deemed competitive to Shudh Matrimonial And Dating Services (opc) Pvt. Ltd. or otherwise. Members should not use the Service or Site for any purposes which are illegal or prohibited in accordance with the applicable laws. Any illegal and/or unauthorized use of the Site, including unauthorized framing of or linking to the Site is not permitted. Such activities will be regularly monitored and investigated and appropriate legal action will be taken by Shudh Matrimonial And Dating Services (opc) Pvt. Ltd., including without limitation, civil, criminal, and injunctive redress against the Members.

7. Other Terms of Use for Members.

• 0. Shudh Matrimonial And Dating Services (opc) Pvt. Ltd. reserves the right in it's sole discretion to review the activity and status of each account and block access of the member where applicable at its sole discretion.
• 1. You hereby confirm that as on date of registration on the Site, you do not have any objection to receive emails, SMS and calls from Shudh Matrimonial And Dating Services (opc) Pvt. Ltd. and members of Shudh Matrimonial And Dating Services (opc) Pvt. Ltd. as long as you are a registered member of Shudh Matrimonial And Dating Services (opc) Pvt. Ltd., including SMS permission for authenticating mobile transactions via OTP, sent by the Payment Gateway. This consent shall supersede any preferences set by you with or registration done with the Do not Disturb (DND Registery)/ National Customer Preference Register (NCPR). This consent extends to emails, messages or calls relating but not limited to phone number verification, the provision of matchmaking advertising service, matchmaking enquiries and promotions.
• 2. Multiple profiles of the same person are not allowed on our Site. Shudh Matrimonial And Dating Services (opc) Pvt. Ltd. reserves the right to deactivate all multiple profiles without any partial/full refund of subscription fees.
• 3. You confirm that the Content, information including the personal information provided by you is correct and accurate.
• 4. You are required to upload a copy of your Driving License, Passport or any other Government issued identity to authenticate the identity and profile of the User intending to avail the Services.
• 5. Except for the purpose of promoting/advertising your profile for matchmaking purposes, you cannot engage in advertising to, or solicitation of, other Members to buy or sell any products or services through the Site.
• 6. You will not transmit any chain letters or junk email to other Shudh Matrimonial And Dating Services (opc) Pvt. Ltd. Members. Shudh Matrimonial And Dating Services (opc) Pvt. Ltd. will monitor the conduct of its Members on the Shudh Matrimonial And Dating Services (opc) Pvt. Ltd. Site to ensure there is no violation of the Terms of use and ensure that the information obtained from other members is not used to harass, abuse, or harm another person/Member, nor should such information obtained be used for the purpose of contacting, advertising, soliciting, or selling any products or services to any Member without their prior explicit consent.
• 7. Shudh Matrimonial And Dating Services (opc) Pvt. Ltd. reserves the right to take appropriate steps to protect Shudh Matrimonial And Dating Services (opc) Pvt. Ltd. and/or its Members from any abuse/misuse as it deems appropriate in its sole discretion.
• 8. You cannot use any automated processes, including IRC Bots, EXE's, CGI or any other programs/ scripts to view content on or communicate / contact / respond / interact with Shudh Matrimonial And Dating Services (opc) Pvt. Ltd. and/or its members.
• 9. Shudh Matrimonial And Dating Services (opc) Pvt. Ltd.reserves the right to screen communications/advertisements that you may send to other Member (s) and also regulate the same by deleting unwarranted/obscene communications/advertisements at any time at its sole discretion without prior notice to any Member.
• 10. Shudh Matrimonial And Dating Services (opc) Pvt. Ltd. Members are expected to exercise simple precautions for their privacy and safety. A suggestive guideline of such precautions is enlisted under security tips "Be Safe Online". By becoming a Member you hereby agree to abide and adhere to the said Tips.
• 11. Shudh Matrimonial And Dating Services (opc) Pvt. Ltd. Members who subscribe to the Service hereby, unconditionally and irrevocably confirm that you have read terms of use and agree to abide by then.

8. Proprietary Rights in the Content on Shudh Matrimonial And Dating Services (opc) Pvt. Ltd.

Shudh Matrimonial And Dating Services (opc) Pvt. Ltd. owns and retains all proprietary rights on the Site. Any such act or an attempted act on your part shall constitute a violation of this Agreement and your membership is liable to be terminated forthwith by Shudh Matrimonial And Dating Services (opc) Pvt. Ltd. without the partial/full refund of any of your unused Subscription fees.Shudh Matrimonial And Dating Services (opc) Pvt. Ltd. reserves right to take legal action (civil and/or criminal) wherever applicable for any violations against the Users.

9. Content Posted on the Site.

• 0. You understand and agree that Shudh Matrimonial And Dating Services (opc) Pvt. Ltd. may delete any listing, content, communication, photos or profiles (collectively, "Content") that in the sole judgment of Shudh Matrimonial And Dating Services (opc) Pvt. Ltd. violates this Agreement or which might be offensive, illegal, or that might violate the rights, harm, or threaten the safety of either Shudh Matrimonial And Dating Services (opc) Pvt. Ltd. and/or its Members.
• 1. With respect to Content you submit or make available for inclusion on publicly accessible areas of the Site including but not limited to your contact details, you hereby unconditionally and irrevocably grant to Shudh Matrimonial And Dating Services (opc) Pvt. Ltd. the license to use, store, distribute, reproduce, prepare derivative works of, modify, adapt, publicly perform and publicly display such Content on the Site and to the members of Shudh Matrimonial And Dating Services (opc) Pvt. Ltd. from time to time.

Ltd. are the sole responsibility of the person from whom such Content originated and shall be at the member's/person's sole risks and consequences. Ltd. will investigate and take appropriate legal action in its sole discretion against anyone who violates this Agreement, including without limitation, removing the offending communication/Content from the Service and terminating the Membership of such violators without a partial/full refund of the Subscription Fee.
• 4. Illegal and prohibitive Content includes Content which:
• • 1. Is blatantly offensive to the community, such as Content that promotes racism, bigotry, hatred or physical harm of any kind against any group or individual;
  • 2. Harasses or advocates harassment of another person;
  • 3. Involves the transmission of "junk mail", "chain letters," or unsolicited mass mailing or "spamming";
  • 4. Promotes information that you know is false, misleading or promotes illegal activities or conduct that is abusive, threatening, obscene, defamatory or libelous;
  • 5. Promotes an illegal or unauthorized copy of another person's copyright work, such as providing pirated computer programs or links to them, providing information to circumvent manufacture-installed copy-protect devices, or providing pirated music or links to pirated music files;
  • 6. Contains restricted or password only access pages, or hidden pages or images (those not linked to or from another accessible page);
  • 7. Displays pornographic or sexually explicit material of any kind;
  • 8. Provides material that exploits people under the age of 21 years in a sexual or violent manner, or solicits personal information from anyone under the age of 21 years;
  • 9. Provided instructional information about illegal activities such as making or buying illegal weapons, violating someone's privacy, or providing or creating computer viruses;

Solicits passwords or personal identifying information for commercial or unlawful purposes from other users; and Engages in commercial activities and/or sales without our prior written consent such as contests, sweepstakes, barter, advertising, and pyramid schemes12. You must use the Service in a manner consistent with any and all applicable local, state, and federal laws, rules and regulations.

10. Copyright Policy.

Ltd. reserves the right, but has no obligation, to monitor disputes between you and other Members. Shudh Matrimonial And Dating Services (opc) Pvt. Ltd. also reserves the right to take appropriate action against errant members. However, Shudh Matrimonial And Dating Services (opc) Pvt. Ltd. is not obliged to share such act with other members, including complainants. Shudh Matrimonial And Dating Services (opc) Pvt. Ltd. expressly disclaims any responsibility or liability for any transactions or interactions between the members inter se.

12. Privacy.

Use of the Site and/or the Service is governed by our Privacy Policy and follow guidelines to protect your privacy.

13. Disclaimers.

Ltd. is not responsible for any problems or technical malfunction of any telephone network or lines, computer on-line-systems, servers or providers, computer equipment, software, failure of email or players on account of technical problems or traffic congestion of the Internet or at any web site or combination thereof, including injury or damage to Users and/or Members or to any other person's computer related to or resulting and/or in connection with the Service.

Ltd. be responsible for any loss or damage resulting from anyone's use of the Site or the Service and/or any Content posted on the Site or transmitted to the Members. Ltd." is not a matrimonial offer and/or recommendation from/by Shudh Matrimonial And Dating Services (opc) Pvt. Ltd.. Shudh Matrimonial And Dating Services (opc) Pvt. Ltd. shall not be responsible for any loss or damage to any individual arising out of, or subsequent to, any relations (including but not limited to matrimonial relations) established pursuant to the use of the Services.

14. Limitation of Liability.

In no event will Shudh Matrimonial And Dating Services (opc) Pvt. If there is any dispute about or involving the Site and/or the Service, by using the Site, you unconditionally agree that all such disputes and/or differences will be governed by the laws of India and shall be subject to the exclusive jurisdiction of the Competent Courts in New Delhi , India only.

16. Indemnity.

You agree to indemnify and hold Shudh Matrimonial And Dating Services (opc) Pvt. Ltd., its subsidiaries, affiliates, officers, agents, and other partners and employees, fully indemnified and harmless from any loss, liability, claim, or demand, including reasonable attorney's fees, made by any third party due to or arising out of your use of the Service in violation of this Agreement and/or any breach of your representations and warranties set forth above and/or any fraudulent act on your part.

You can unsubscribe the e-mails by clicking the 'unsubscribe link' enclosed in all the emails sent by Shudh Matrimonial And Dating Services (opc) Pvt. Ltd.. You can also manage your subscription to these emails using the My Alert Manager option.

This Agreement, accepted upon use of the Site and further affirmed by becoming a Member of the Service, contains the entire agreement between you and Shudh Matrimonial And Dating Services (opc) Pvt. Ltd. regarding the use of the Site and/or the Service. If any provision of this Agreement is held invalid, the validity, legality, enforceability of the remaining provisions shall not in any way be affected or impaired thereby. Ltd. and/or using/accessing the Services of the Site, you unconditionally and irrevocably confirm that you have read and understood the above provisions and agree to abide by them.
